1. Introduction & Acceptance
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Global Connect Express Inc., operating as RemitClick (“RemitClick,” “we,” “us,” or “our”), a company registered in Canada and licensed as a Money Services Business (MSB) under the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC), Registration Number M23456340.
By creating an account, accessing, or using any of RemitClick's services — including our website, mobile application, and money transfer platform — you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookies Policy. If you do not agree to these Terms, you must not use our services.
2. Definitions
- “Services” means the international money transfer, currency exchange, stablecoin payment, multi-currency wallet, and any other financial services provided by RemitClick through our platform.
- “Platform” means the RemitClick website (remitclick.com), web application (app.remitclick.com), and any associated mobile applications.
- “Transaction” means any money transfer, currency exchange, deposit, withdrawal, or other financial operation initiated through our Platform.
- “Recipient” means the individual or entity designated to receive funds through a Transaction.
- “Business Account” means an account opened by a legal entity for commercial remittance or payment integration purposes.
3. Eligibility
To use RemitClick's Services, you must:
- Be at least 18 years of age (or the legal age of majority in your jurisdiction).
- Be a resident of a country or jurisdiction where RemitClick is authorized to operate.
- Provide accurate, current, and complete identification and personal information as required during registration and verification.
- Not be listed on any government sanctions list, including but not limited to lists maintained by the United Nations, OFAC, the European Union, or the Government of Canada.
- Not have been previously suspended or terminated from using RemitClick's Services.
For Business Accounts, the entity must be legally incorporated and authorized to conduct business in its jurisdiction. Business Account holders must designate an authorized representative to manage the account.
4. Account Registration & Verification
4.1 Account Creation
To access our Services, you must create an account by providing your full legal name, email address, phone number, and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
4.2 Identity Verification (KYC)
In compliance with Canadian anti-money laundering (AML) and counter-terrorism financing (CTF) regulations, RemitClick is required to verify your identity before you can initiate Transactions. You must provide valid government-issued photo identification and may be required to provide additional documentation such as proof of address, source of funds, or other information as deemed necessary. We use third-party identity verification providers to process your verification securely.
4.3 Account Security
You agree to immediately notify RemitClick of any unauthorized use of your account or any security breach. RemitClick shall not be liable for any loss arising from your failure to protect your account credentials. We strongly recommend enabling two-factor authentication (2FA) when available.
5. Services & Transactions
5.1 Money Transfers
RemitClick enables you to send money internationally to supported destinations. Transfers are subject to applicable exchange rates, transfer limits, and availability of service corridors. The estimated delivery time for each Transaction is provided at the time of initiation but is not guaranteed, as delivery depends on factors including but not limited to recipient bank processing times, regulatory checks, and network conditions.
5.2 Exchange Rates
Exchange rates displayed on our Platform are determined by RemitClick and may include a margin above the mid-market rate. Rates are locked at the time you confirm a Transaction and are valid for that specific Transaction only. Rates fluctuate and may differ between the time you view them and the time you confirm your Transaction.
5.3 Fees
RemitClick strives to offer transparent pricing. Applicable fees, if any, are clearly displayed before you confirm each Transaction. By confirming a Transaction, you agree to the total cost including any applicable fees and the exchange rate applied.
5.4 Transaction Limits
Transactions are subject to minimum and maximum limits, which may vary based on your verification level, account history, sending and receiving countries, and payment method. Current limits are displayed in your account dashboard and may be adjusted at RemitClick's discretion in compliance with regulatory requirements.
5.5 Stablecoin & Blockchain Services
RemitClick may utilize blockchain networks and stablecoin technology to facilitate Transactions. While blockchain-based transfers are generally faster, they are subject to network conditions and confirmation times. You acknowledge the inherent risks of blockchain technology, including but not limited to network congestion, smart contract risks, and regulatory changes affecting digital assets.
6. Prohibited Activities
You agree not to use RemitClick's Services for:
- Money laundering, terrorism financing, or any illegal activity.
- Transactions involving proceeds of crime or funds derived from unlawful sources.
- Fraud, identity theft, or misrepresentation of your identity or the purpose of a Transaction.
- Circumventing Transaction limits, sanctions, or other regulatory controls.
- Transferring funds to or from individuals, entities, or countries subject to international sanctions.
- Operating an unauthorized money services business through your RemitClick account.
- Any activity that violates applicable laws, regulations, or these Terms.
- Gambling, adult entertainment, illicit drugs, weapons, or other restricted goods and services.
RemitClick reserves the right to refuse, suspend, or cancel any Transaction and to suspend or terminate your account if we suspect any prohibited activity, without prior notice.
7. Cancellations & Refunds
7.1 Cancellation by User
You may request cancellation of a Transaction before it has been processed and delivered to the Recipient. Once funds have been delivered, cancellation is generally not possible. To request a cancellation, contact our support team immediately.
7.2 Cancellation by RemitClick
RemitClick may cancel a Transaction at any time if we determine, at our sole discretion, that the Transaction violates these Terms, applicable laws, or our internal compliance policies. In such cases, we will refund the principal amount to your original payment method, minus any non-recoverable third-party fees incurred.
7.3 Refund Policy
Refunds for cancelled Transactions are processed within 5-10 business days to your original payment method. Exchange rate differences between the time of the original Transaction and the refund are not compensated. RemitClick is not responsible for any fees charged by your bank or payment provider in connection with a refund.
8. Compliance & Regulatory Obligations
RemitClick operates in compliance with:
- The Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) of Canada.
- FINTRAC regulations and reporting requirements.
- International sanctions administered by the United Nations, OFAC, and other relevant authorities.
- Applicable provincial and federal laws in Canada and the laws of jurisdictions where we operate.
As part of our compliance obligations, we may be required to report certain Transactions to regulatory authorities, place holds on suspicious Transactions, and request additional documentation from you at any time. Your cooperation with such requests is a condition of continued use of our Services.
9. Intellectual Property
All content, trademarks, logos, software, designs, and materials on the RemitClick Platform are the exclusive property of Global Connect Express Inc. or its licensors and are protected by Canadian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any content on our Platform without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- RemitClick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services.
- RemitClick's total aggregate liability for any claims arising from these Terms or your use of our Services shall not exceed the total fees paid by you to RemitClick in the twelve (12) months preceding the claim.
- RemitClick shall not be liable for delays, failures, or errors caused by factors beyond our reasonable control, including but not limited to bank processing delays, network failures, regulatory actions, natural disasters, or acts of government.
- RemitClick shall not be liable for losses arising from exchange rate fluctuations after a Transaction has been confirmed.
11. Indemnification
You agree to indemnify, defend, and hold harmless RemitClick, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of or access to our Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights.
12. Privacy & Data Protection
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using our Services, you consent to the data practices described in the Privacy Policy. RemitClick is committed to protecting your data in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
13. Account Suspension & Termination
RemitClick may suspend or terminate your account at any time, with or without cause, including but not limited to:
- Violation of these Terms or any applicable law.
- Suspected fraudulent, illegal, or unauthorized activity.
- Failure to complete required identity verification.
- Inactivity for an extended period as defined by our policies.
- Regulatory or legal requirements.
You may close your account at any time by contacting our support team. Upon termination, any pending Transactions may be cancelled and funds returned to you in accordance with our refund policy, subject to any legal holds or regulatory requirements.
14. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of RemitClick's Services shall first be addressed through our internal complaints process by contacting support@remitclick.com. If the dispute cannot be resolved through our internal process within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the ADR Institute of Canada, with the arbitration taking place in Toronto, Ontario, Canada. The language of arbitration shall be English. This arbitration clause does not prevent you from filing a complaint with FINTRAC or any other applicable regulatory body.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of competent jurisdiction in Ontario, Canada.
16. Amendments
RemitClick reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on our Platform at least thirty (30) days before the changes take effect. Your continued use of our Services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must discontinue use of our Services and close your account.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
